COSTS OF HIRING A LAWYER IN BRAZIL

Fees for family lawyers (alimony, custody), Successions, Civil and criminal.

In this article we offer a general idea of attorney fee amounts for various situations, providing information about existing billing methods and amounts.

Lawyers know that cost is a very important point in hiring any service. Legal professionals can – and should – present viable alternatives that fit the potential client’s possibilities, with a good cost-benefit ratio.

Depending on the type of case, there are different payment options and facilities – from so-called ad exitum fees (that is, contingent on the success of the action) to fixed monthly installment payments. It’s important that the lawyer present such options right at the beginning of the contract and remain faithful to this transparency throughout the entire course of the work.

In the civil litigation area, when the case has economic content (such as compensation, alimony action, real estate law, etc.), the price is normally composed of an initial amount and a percentage of the benefit obtained in case of success in the action (generally up to 20%). For situations without economic content (such as those in family law: custody action or name change, for example) the price is formed by an initial installment and a final installment, in case of success. This is also, in general, the billing method used by criminal lawyers.

In labor law and social security law (retirement), there is normally no initial charging of amounts, but the final amount to be paid to the lawyer is higher – normally 30%.

But there are other billing methods that can be established by each professional. For more information, click on the links presented below.

Also keep in mind that there are lawyers who offer free initial consultation if the problem requires filing a lawsuit or defense. Others do not act in this manner.
